1. Who we are

WakePix (wakepix.com, "the Service") is operated by Clooms Tech ("Clooms Tech", "we", "us"), Boulder, Colorado, United States. Contact: support@wakepix.com. By using the Service you agree to these terms, our Privacy Policy, our Acceptable Use Policy and our Refund Policy.

2. The Service

WakePix is a digital software-as-a-service product that turns two photos and an optional topic into a short AI-generated rap duo video. Delivery is digital and immediate once a video finishes rendering (usually about four minutes).

AI models. Videos are generated with ByteDance's Seedance 2.0 video models (the "Fast" and "Standard" options), and optional lyrics are written by a large language model (OpenAI GPT-5.2, with Google Gemini 3 Pro as a fallback). These models are accessed through a third-party API provider. Results vary, and we do not promise that a video will look identical to the people in your photos.

3. Eligibility and your account

You must be at least 18 years old. You must give accurate information, keep your sign-in credentials confidential, and you are responsible for everything that happens under your account.

4. Photos and permission

Before each video you confirm that you own the photos or have the clear permission of every person in them, and that everyone shown is an adult. We record the time and IP address of this confirmation.

You must not upload photos of celebrities, politicians or other public figures, of anyone under 18, or of anyone who has not agreed. You must not use WakePix to create sexual, hateful, violent or deceptive content or to impersonate anyone. The full rules are in the Acceptable Use Policy, which forms part of these terms.

5. Credits, plans and payments

  • Videos cost credits; the cost is shown before you generate.
  • Credit packs are one-time purchases. Each purchase is a separate payment you authorize. Pack credits do not expire.
  • Monthly and yearly plans renew automatically until you cancel. By subscribing you authorize us and our payment provider to charge your payment method every period. Monthly plan credits are granted each month and unused monthly credits expire at the end of that period. Yearly plan credits are granted up front and are valid for the plan year.
  • You can cancel in the product at any time under Settings → Billing. Cancellation takes effect at the end of the paid period, and you keep access until then.
  • Prices are in US dollars and are shown before checkout. Applicable taxes are handled at checkout.
  • Payment processing. Orders are processed by our payment provider and Merchant of Record, Waffo Pancake. Your card details are handled by Waffo Pancake (PCI-DSS compliant) and are never stored on our servers.

6. Failed videos and refunds

If a video fails or times out, the credits are returned to your balance automatically. Other refunds follow our Refund Policy.

7. Your content and AI outputs

  • Ownership. As between you and us, the videos generated from your photos belong to you. We do not claim ownership of your photos or your videos.
  • Licence to us. You give us a limited licence to store and process your photos, topics and videos only to provide the Service to you, to keep it safe, and to comply with the law.
  • No training. We do not use your photos or videos to train AI models, and we do not sell them. Our AI providers process them only to render your video.
  • Retention. Uploaded photos are deleted automatically 30 days after upload. Videos stay in your account until you or we delete them.
  • Disclosure. Videos are AI-generated and carry an AI-generated tag in their file data. You agree to keep an AI-generated disclosure when you share a video wherever a platform or law requires it, and not to present it as real footage.
  • AI limits. AI output can be inaccurate or unexpected. Do not rely on it for anything important.

8. Moderation, enforcement and appeals

We may screen inputs and outputs, block or remove content, limit or suspend accounts, and report unlawful content as described in the Acceptable Use Policy. You can report a problem or appeal a decision at support@wakepix.com.

9. Our rights

The WakePix name, site, software and design belong to Clooms Tech. You may not copy, resell or reverse engineer the Service, or use its outputs to train competing AI systems.

10. Disclaimer and limit of liability

The Service is provided "as is" and "as available". To the fullest extent the law allows, Clooms Tech is not liable for indirect, incidental or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Suspension and termination

We may suspend or close accounts that break these terms or the Acceptable Use Policy. You may stop using the Service and delete your account at any time.

12. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules. Courts located in Boulder County, Colorado have exclusive jurisdiction, except where the law of your country gives you mandatory rights.

13. Changes

We may update these terms. Material changes will be announced on this page or by email at least 30 days before they take effect; continued use afterwards means you accept them.
